Rights and Revenue Protocol

You don't know your rights.
But your HR Dept does.

Whether you are burnt to a crisp or profoundly detached and dreading the next Slack ping, a week in Tulum will not fix your nervous system. You need a structured medical leave funded by the insurance policy your company already pays for. We build the medical case to secure it.

The income reality.

FMLA protects your job title, but it does not pay your rent.

Option 1: The Band-Aid
Paid Sick Days
100% pay
Your standard PTO. Automatic and safe, but temporary. It only masks the burnout.

The risk: it runs out in about 7 days.
Verdict: too short
Option 2: The Trap
FMLA / Unpaid
$0 / week
Federal law protects your role for 12 weeks, but leaves your paycheck at zero.

The risk: you keep your title but drain your personal savings to survive.
Verdict: unaffordable
Option 3: The Goal
Private STD
Up to 100%
Your employer's insurance policy (Lincoln, Guardian, MetLife) replaces your income while you heal.

The risk: they deny 60% of claims for lack of objective medical evidence.
Verdict: PIM required

Continue to the eligibility audit.

You read the income reality. You ran your pattern against the cross-screeners. If burnout is what is actually going on and you need time off, the next step is our 4-question eligibility audit. It tells you whether your situation qualifies for FMLA, short-term disability, or both.

Want the law in plain English first? Read our guide to FMLA for mental health. In Florida? The rules are different — see our Florida medical leave guide.

The corporate conditioning.

You would not walk on a broken ankle. Why try to code, manage, and execute with a depleted nervous system?

PIM BRIEFING · VIRAL
@dralkatib

What can I do when I'm burned out from work?

original sound - Dr. Ahmed Al-Katib
Will my boss know my diagnosis?

No. Your medical records are protected by HIPAA. When PIM files your Private STD claim, we deal directly with the third-party insurance carrier (Sedgwick, Lincoln Financial, Guardian, MetLife). Your HR department and your direct manager only receive a generic notice that you are on Approved Medical Leave and your expected return date.

Can they fire me for taking leave?

Retaliation is a federal offense. Under the Family and Medical Leave Act (FMLA) and the Americans with Disabilities Act (ADA), you are federally protected. Firing an employee while on, or immediately returning from, a documented medical leave is a massive legal liability. You are safer on documented leave than you are underperforming at your desk.

I feel guilty leaving my team.

Corporate culture conditions you to feel guilty for having a biological limit. But burnout-related exhaustion is a physiological reality. Your nervous system is flooded with cortisol and your executive function is impaired. You are currently giving your team a fractured version of yourself. Taking this time is how you repair the machine.

Is burnout an official medical diagnosis?

The World Health Organization classifies burnout in ICD-11 (code QD85) as an occupational phenomenon characterized by exhaustion, mental distance from one's job, and reduced professional efficacy.

Burnout is not a stand-alone diagnosis in the US DSM-5, but its symptoms (insomnia, anxiety, cognitive impairment, depressed mood) are clinically recognized and treatable, and they typically meet criteria for diagnoses like Adjustment Disorder, Major Depressive Episode, or Generalized Anxiety, which qualify for short-term disability and FMLA.

How much will I actually be paid during leave?

It depends on the path you take. FMLA itself is unpaid. New York DBL caps weekly benefits at $170. The path that pays your real salary is Private Short-Term Disability, the policy your employer pays for through carriers like Lincoln, Guardian, or MetLife. STD typically replaces 60 to 100 percent of your salary for the duration of leave when the documentation meets the carrier's evidence standard.

How long is a typical medical leave for burnout?

Most claims are filed for an initial 6 to 12 weeks, often extended to 12 weeks under FMLA. Carriers reauthorize in 30-day increments based on continued clinical documentation. PIM's protocol aligns weekly visits with the leave duration so the carrier always has fresh evidence to reauthorize the claim.

What states does Psychiatry in Motion serve?

PIM provides direct care to patients in New York, Florida, and New Jersey — in person at our Williamsburg office and via secure telehealth across all three states. Most STD and FMLA claims route through your employer's ERISA plan, so the physical location of your psychiatrist matters less than where the psychiatrist is licensed. Out-of-state patients can be referred to vetted local colleagues.

What insurance does PIM accept for the weekly visits?

PIM is in-network directly with Aetna and UnitedHealthcare in NY (including Oscar, Optum, and Oxford). Cigna and BCBS are processed through Headway. We provide automatic superbills for out-of-network reimbursement, and we accept HSA and FSA funds for qualifying expenses.

The ultimatum

You have two choices. You can continue to grind your nervous system into dust until you make a catastrophic error or get fired for poor performance. Or, you can exercise your legal right to step away, let the insurance company pay your salary, and rebuild your brain. Which sounds like the smarter executive decision?

We build the shield.
You rebuild your brain.

Insurance carriers deny claims when treatment is sporadic. We don't just write a note and hope for the best. We align the duration of your medical leave exactly with our intensive clinical protocol.

Your health insurance covers the weekly visits. The Private STD carrier gets the continuous data they need to authorize your checks. You get the space to return sharper and more resilient than you've ever been.
